Are you ready for the new rules of the game for industrial data?

The EU has adopted new legislation that introduces clear rules on the management of data generated by devices and digital services. The new European regulation, the EU Data Act, brings the biggest change in data management since the introduction of GDPR, except that this time it concerns industrial data generated by devices. The companies directly affected by the regulation include those that use smart meters, sensors and SCADA systems, or operate in environments where data is collected and processed in the public interest.

The European EU Data Act regulation defines:

  • who has the right to access data,
  • how it must be shared,
  • how to ensure transparency and fairness in its use.

It was adopted because the EU lacks uniform rules on industrial data, data ownership and access to data from the devices that companies and public services use every day.

Does the new regulation apply to you too?

The EU Data Act applies to:

  • all manufacturers of smart devices,
  • providers of digital services,
  • companies and public institutions that use or transmit data.

One of the groups for which the EU Data Act rules are particularly important is utility companies that manage infrastructure for:

  • water,
  • waste,
  • energy.

The new regulation is especially important for companies that share data with municipalities or external contractors, or use it for internal optimisation.

When does it apply?

The regulation applies from 12 September 2025. By then, companies must:

  • set up a system for tracking and controlling data,
  • ensure data is accessible to authorised third parties,
  • be prepared for inspections or data-sharing requests.

What are the risks for your company?

If a company fails to ensure compliance:

  • it faces sanctions under European and national legislation,
  • this may affect its cooperation with municipalities, public tenders and the trust of users or partners,
  • poorly organised data management means greater operational and legal risk.

How does SmartTwin reduce your risks and save you time?

At Smartis, we have developed the SmartTwin platform, designed specifically for companies that collect and manage large amounts of data from smart devices.

Among other things, SmartTwin enables:

  • centralised management of data from smart devices and sensors,
  • creating data rights and access for different types of users,
  • compliance with the EU Data Act,
  • visualisation of infrastructure (water supply networks, wastewater treatment plants, sewerage, etc.),
  • integration with existing SCADA or ERP systems,
  • automated reporting and support for internal and regulatory needs.

No stress when the client requests data

In practice, these are everyday situations, but the new rules will make them even more demanding. The companies to which these rules particularly apply include utility companies that manage large amounts of data collected through smart meters, sensors and monitoring systems. When a municipality, as the client, requests accurate and verifiable data, the system must be responsive, traceable and properly organised. Without this, the risk of ambiguity, errors and mistrust keeps growing.

How a company collects data without SmartTwin:

An employee of the utility company has to export the data manually, prepare an explanation, check who has access and collect approvals. Stress, time pressure, questions about who has access to the data, who can export it …

With SmartTwin:

  • The system automatically records who accessed the data and what types of data were shared.
  • Every request is automatically recorded and confirmed (including the date, user and data types).
  • A monthly report for internal use and audit is generated, showing: who requested the data, what types of data were shared, and whether the request complied with internal policies.

The system automatically records the request, triggers the correct sharing process and prepares an audit report. Everything runs quickly, without delays, without stress and in compliance with the law.
